• Captures and digitizes handwritten notes from various sources (smart pens, tablets, paper scans)
• Processes notes using artificial intelligence to transcribe, summarize, and organize content
• Stores and synchronizes your notes across devices
• Provides search, collaboration, and visualization features
• Offers AI-powered assistants (Shakespr QI and QARTO) for enhanced productivity
The Services are offered in different subscription tiers with varying features and usage limits.

To use our Services, you must create an account by providing a valid email address and setting up authentication through our secure systems (Firebase Authentication).

You retain full ownership and intellectual property rights over all content you create, upload, or process through Shakespr. This includes your handwritten notes, images, documents, and any other materials you provide.
By using our Services, you grant us a limited license to:
• Store and process your content to provide the Services
• Create backups for data security
• Display your content to you across devices

4.2 Shakespr Property
Shakespr retains all rights to:
• The Shakespr name, logo, and trademarks
• The software, algorithms, and AI models powering our Services
• The design, features, and functionality of our applications
• AI-generated insights, summaries, and organizational structures (while you own the underlying content)

4.3 No AI Training
We do not use your personal notes or content to train our AI models. Your content is processed solely to provide you with the requested features and is not used for machine learning training purposes.
5. Subscriptions and Payments
5.1 Free and Paid Plans
Shakespr offers:
• Shakespr QI: A free tier with limited features and usage quotas
• QARTO: A premium subscription with enhanced features and higher limits

5.2 Mobile Subscriptions
Mobile app subscriptions are processed through RevenueCat and billed via the Apple App Store or Google Play Store. Subscription terms, billing cycles, and cancellation procedures are governed by the respective app store's policies.
5.3 Subscription Changes
• Upgrades take effect immediately with prorated billing
• Downgrades take effect at the end of the current billing period
• We reserve the right to modify pricing with 30 days' notice

5.4 Refunds
Refund policies for mobile subscriptions are governed by Apple App Store and Google Play Store policies. For other payment methods, contact us within 14 days of purchase for refund requests.

You agree NOT to use Shakespr to:
• Upload, store, or transmit illegal content
• Violate any laws or regulations
• Infringe on intellectual property rights of others
• Distribute malware, viruses, or harmful code
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Services
• Reverse engineer, decompile, or attempt to extract source code
• Use automated systems (bots, scrapers) without permission
• Create accounts for fraudulent purposes
• Share account credentials with others
• Circumvent usage limits or quota restrictions
• Use the Services to compete directly with Shakespr
Violation of these terms may result in immediate account suspension or termination.

7.1 AI Processing
Your notes are processed by AI systems to provide features such as transcription, summarization, tagging, and search. This processing is done solely to deliver the Services you request.
7.2 Third-Party AI Providers
We use third-party AI services (including OpenAI, Anthropic, Mistral, Google) to process your content. These providers process data under strict contractual obligations and data protection agreements.
7.3 Processing Accuracy
AI-generated content (transcriptions, summaries, insights) is provided "as is" and may contain errors. You are responsible for reviewing and verifying AI-generated content before relying on it for important decisions.
8. Service Availability
• We strive to maintain 99.9% service availability but do not guarantee uninterrupted access
• Scheduled maintenance will be announced in advance when possible
• We are not liable for service interruptions due to factors beyond our control
• We reserve the right to modify, suspend, or discontinue features with reasonable notice

9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
• Shakespr is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
• We are not liable for indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
• We are not responsible for data loss; you are encouraged to maintain your own backups
• We are not liable for errors or inaccuracies in AI-generated content
These limitations do not affect your statutory rights as a consumer under French and EU law.

Jurisdiction: Any disputes arising from these Terms or your use of the Services shall be submitted to the exclusive jurisdiction of the courts of Angoulême, France.
EU Consumer Rights: If you are a consumer in the European Union, you retain the benefit of any mandatory provisions of the law of your country of residence. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions.
